第133条代理的一般原则

（1）除了第2款之外，不得强迫任何人在本公约规定的程序中应当由专利代理人代理；

（2）在缔约国没有居所或营业所的自然人或法人应当由专利代理人代理，并且通过他代理本公约规定的除递交欧洲专利申请之外的程序；实施细则可以允许其他的例外；

（3）在缔约国有居所或营业所的自然人或法人在本公约规定的程序中可由职员代表，职员不需要是专利代理人但应当根据实施细则获得授权；实施细则可规定是否和在什么条件下法人的职员代理其他在缔约国有营业所并与第一个法人有经济关系的其他法人；

（4）实施细则可以制定与共同参与各方共同代理有关的特别条款。

(1)Subject to paragraph 2,no person shall be compelled to be represented by a professional representativein proceedings established by this Convention.

(2)Natural or legal persons not having theirresidence or principal place of business in a Contracting State shall be representedby a professional representative and act through him in all proceedingsestablished by this Convention, other than in filing a European patentapplication; the Implementing Regulations may permit other exceptions.

(3)Natural or legal persons having theirresidence or principal place of business in a Contracting State may berepresented in proceedings established by this Convention by an employee, whoneed not be a professional representative but who shall be authorised inaccordance with the Implementing Regulations. The Implementing Regulations mayprovide whether and under what conditions an employee of a legal person mayalso represent other legal persons which have their principal place of businessin a Contracting State and which have economic connections with the first legalperson.

(4)The Implementing Regulations may lay downspecial provisions concerning the common representation of parties acting incommon.

第134条欧洲专利局的代理人

（1）自然人或法人在本公约规定的程序中的代理只能由记载在欧洲专利局针对代理而维持的专利代理人名册中的专利代理人承担；

（2）符合下述条件的任何人：

（a）是缔约国国民；

（b）在缔约国有营业所或就业以及

（c）通过欧洲专利代理人资格考试

可以进入专利代理人名册。

（3）在加入本公约生效日起一年内，如何下述条件的任何自然人可以请求进入专利代理人名册：

（a）是缔约国国民；

（b）在加入本公约的缔约国内具有营业所或就业以及

（c）在该缔约国的中央工业产权局有资格代理自然人或法人的专利事宜；如果该资格不是有条件地基于特别专业资格的要求，该自然人应当在该缔约国正常执业至少5年。

（4）登记应当依申请生效，随附指明满足第2款或第3款条件的证书；

（5）记载在专利代理人名册上的人有资格在本公约规定的所有程序中代理；

（6）为了作为专利代理人的目的，记载在专利代理人名册上的任何人有资格在任何缔约国内设立营业所，营业所内可以进行与本公约所附的集中化原则有关的本公约规定的程序；只有在为了公共安全、法律和秩序的目的适用了法律规定的情况下，缔约国的有权机关才能在个别案件中剥夺代理资格；在采取措施以前，应当咨询欧洲专利局局长。

（7）欧洲专利局局长可以豁免：

（a）特殊情况下第2（a）款和第3（a）款的要求；

（b）如果申请人证明他通过其他方式获得必要的资格，第3（c）款第二句的要求。

（8）本公约规定的程序也可以由在缔约国有营业所的执业律师以与专利代理人同样的方式承担，只要他有资格在该缔约国作为专利代理人代理专利事宜。应当准用第6款。

(1)Representation of natural or legalpersons in proceedings established by this Convention may only be undertaken byprofessional representatives whose names appear on a list maintained for thispurpose by the European Patent Office.

(2)Any natural person who

(a)is a national of a ContractingState,

(b)has his place of business or employmentin a Contracting State and

(c)has passedthe European qualifying examination

may be entered on the list of professional representatives.

(3)During a period of one year from the dateon which the accession of a State to this Convention takes effect, entry onthat list may also be requested by any natural person who

(a)is a national of a ContractingState,

(b)has his place of business or employmentin the State having acceded to the Convention and

(c)is entitled to represent natural orlegal persons in patent matters before the central industrial property officeof that State. Where such entitlement is not conditional upon the requirementof special professional qualifications, the person shall have regularly soacted in that State for at least five years.

(4)Entry shall be effected upon request,accompanied by certificates indicating that the conditions laid down in paragraph 2 or 3 arefulfilled.

(5)Persons whose names appear on the list ofprofessional representatives shall be entitled to act in all proceedingsestablished by this Convention.

(6)For the purpose of acting as aprofessional representative, any person whose name appears on the list ofprofessional representatives shall be entitled to establish a place of businessin any Contracting State in which proceedings established by this Conventionmay be conducted, having regard to the Protocol on Centralisation annexed tothis Convention. The authorities of such State may remove that entitlement inindividual cases only in application of legal provisions adopted for thepurpose of protecting public security and law and order. Before such action istaken, the President of the European Patent Office shall be consulted.

(7)The President of the European PatentOffice may grant exemption from:

(a)the requirement of paragraphs 2(a) or 3(a) inspecial circumstances;

(b)the requirement of paragraph 3(c),second sentence, if the applicant furnishes proof that he has acquired therequisite qualification in another way.

(8)Representation in proceedings establishedby this Convention may also be undertaken, in the same way as by a professionalrepresentative, by any legal practitioner qualified in a Contracting State andhaving his place of business in that State, to the extent that he is entitledin that State to act as a professional representative in patent matters. Paragraph 6 shallapply mutatis mutandis.

第134a条欧洲专利局的专利代理人协会

（1）行政委员会有权通过和修改下述有关条款：

（a）欧洲专利局的专业代表人协会，此后称协会；

（b）准许参加欧洲专利代理人资格考试者需要的资格和培训并组织该考试；

（c）欧洲专利代理人协会或欧洲专利局关于专利代理人的纪律惩戒权；

（d）专利代理人的保密义务以及在欧洲专利局的程序中有关专利代理人与其客户或者其他任何人通信不予公开的特权；

（2）根据第134条第1款记载在专利代理人名册的任何人应当是协会的成员。

(1)The Administrative Council shall becompetent to adopt and amend provisions governing:

(a)theInstitute of Professional Representatives before the European Patent Office,hereinafter referred to as the Institute;

(b)the qualifications and trainingrequired of a person for admission to the European qualifying examination andthe conduct of such examination;

(c)thedisciplinary power exercised by the Institute or the European Patent Office inrespect of professional representatives;

(d)the obligation of confidentiality onthe professional representative and the privilege from disclosure in proceedingsbefore the European Patent Office in respect of communications between aprofessional representative and his client or any other person.

(2)Any person entered on the list ofprofessional representatives referred to in Article 134,paragraph 1, shall be a member of the Institute.
