第127条欧洲专利登记簿

欧洲专利局应维持欧洲专利登记簿，其中应当记录实施细则规定的事项；在欧洲专利申请公开之前，欧洲专利登记簿不应记载任何事项；欧洲专利登记簿应当公开以供公众查阅。

The European Patent Office shall keep a European Patent Register, inwhich the particulars specified in the Implementing Regulations shall berecorded. No entry shall be made in the European Patent Register before thepublication of the European patent application. The European Patent Registershall be open to public inspection.

第128条案卷查阅

（1）未经申请人同意，与未公开的欧洲专利申请相关的文件不得查阅；

（2）能证明申请人对其援引欧洲专利申请的权利的任何人，可以在申请公开之前并且无需申请人同意而查阅文件；

（3）欧洲分案申请或者根据第61条第1款递交的新专利申请公开后，任何人可无需申请人同意而查阅早于该申请公开的在先申请文件；

（4）在欧洲专利申请公开之后，与申请以及授权的欧洲专利有关的文件，可以根据实施细则规定的条件请求查阅；

（5）欧洲专利局可在欧洲专利申请公布前，向第三方通知或公开实施细则中规定的事项。

(1)Files relating to European patentapplications which have not yet been published shall not be made available forinspection without the consent of the applicant.

(2)Any person who can prove that theapplicant has invoked the rights under the European patent application againsthim may obtain inspection of the files before the publication of thatapplication and without the consent of the applicant.

(3)Where a European divisional applicationor a new European patent application filed under Article 61,paragraph 1, is published, any person may obtain inspection ofthe files of the earlier application before the publication of that applicationand without the consent of the applicant.

(4)After the publication of the Europeanpatent application, the files relating to the application and the resultingEuropean patent may be inspected on request, subject to the restrictions laiddown in the Implementing Regulations.

(5)Even before the publication of the Europeanpatent application, the European Patent Office may communicate to third partiesor publish the particulars specified in the Implementing Regulations.

第129条定期出版物

欧洲专利局应当定期出版：

（a）欧洲专利公报，其包含本公约、实施细则或欧洲专利局局长规定的事项；

（b）官方杂志，其包含欧洲专利局局长颁布的一般性通知和信息，以及与本公约或其实施细则有关的其他任何信息。

The European Patent Office shall periodically publish:

(a)a European Patent Bulletin containing theparticulars the publication of which is prescribed by this Convention, theImplementing Regulations or the President of the European Patent Office;

(b)an Official Journal containing noticesand information of a general character issued by the President of the EuropeanPatent Office, as well as any other information relevant to this Convention orits implementation.

第130条情报交流

（1）除本公约或国内法另有规定外，欧洲专利局和任何缔约国的中央工业产权局应根据请求互相交流与欧洲或国内专利申请和专利以及与其有关程序的有用情报；

（2）第1款应当适用于欧洲专利局和下列组织之间根据工作协议交流情报：

（a）其他国家的中央工业产权局；

（b）任何接受委托授予专利权的政府间组织；

（c）其他组织

（3）根据第1款、第2（a）款和第2（b）款的通知不受第128条规定的限制；如果有关组织对欧洲专利申请公开之前的情报交流保密，则行政委员会可以决定根据第2（c）款的情报交流不受这些限制。

(1)Unless this Convention or national lawsprovide otherwise, the European Patent Office and the central industrialproperty office of any Contracting State shall, on request, communicate to eachother any useful information regarding European or national patent applicationsand patents and any proceedings concerning them.

(2)Paragraph 1 shallapply to the communication of information by virtue of working agreementsbetween the European Patent Office and

(a)the central industrial property officesof other States;

(b)any intergovernmental organisationentrusted with the task of granting patents;

(c)any other organisation.

(3)Communications under paragraphs 1 and 2(a) and (b) shallnot be subject to the restrictions laid down in Article 128.The Administrative Council may decide that communications under paragraph 2(c)shallnot be subject to such restrictions, provided that the organisation concernedtreats the information communicated as confidential until the European patentapplication has been published.

第131条行政和法律合作

（1）除本公约和国内法另有规定外，欧洲专利局和缔约国的法院或机构应根据请求，通过交流情报或开放查阅文件来互相帮助；如果欧洲专利局制作供法院、检察院或中央工业产权局可用的文件，查阅不受第128条规定的约束。

（2）根据欧洲专利局的请求，缔约国法院或其他有权机关应当代表该局并在其权限范围内，采取必要的调查或其他法律步骤；

(1)Unless this Convention or national lawsprovide otherwise, the European Patent Office and the courts or authorities ofContracting States shall on request give assistance to each other bycommunicating information or opening files for inspection. Where the EuropeanPatent Office makes files available for inspection by courts, PublicProsecutors' Offices or central industrial property offices, the inspectionshall not be subject to the restrictions laid down in Article 128.

(2)At the request of the European PatentOffice, the courts or other competent authorities of Contracting States shallundertake, on behalf of the Office and within the limits of their jurisdiction,any necessary enquiries or other legal measures.

第132条出版物交换

（1）欧洲专利局和缔约国中央工业产权局应根据请求和自己的需要免费交换一份或多分各自的出版物；

（2）欧洲专利局可以缔结与交换或提供出版物的协议。

Article 132 Exchange of publications

(1)The European Patent Office and thecentral industrial property offices of the Contracting States shall despatch toeach other on request and for their own use one or more copies of theirrespective publications free of charge.

(2)The European Patent Office may concludeagreements relating to the exchange or supply of publications.
