欧洲专利公约译文(中英文对照)——第52条-第57条

52可授予专利的发明

1)所有技术领域中具有新颖性、创造性和易于工业应用的任何发明,应当授予欧洲专利。

2)特别地,下述各项不应视为第1款中的发明:

a)发现,科学理论和数学方法;

b)艺术创作;

c)进行智力活动、玩游戏、经营商业的方案、规则和方法,以及计算机程序;

d)信息呈现;

3)只有在欧洲专利申请或者欧洲专利涉及第2款规定的客体或行为的情况下,第2款才应当排除该款所指客体或行为的可专利性。

Article 52 Patentable inventions

(1)European patents shall be granted for any inventions, in allfields of technology, provided that they are new, involve an inventive step andare susceptible of industrial application.

(2)The following in particular shall not beregarded as inventions within the meaning of paragraph 1:

(a)discoveries, scientific theories andmathematical methods;

(b)aesthetic creations;

(c)schemes, rules and methods forperforming mental acts, playing games or doing business, and programs forcomputers;

(d)presentations of information.

(3)Paragraph 2 shallexclude the patentability of the subject-matter or activities referred totherein only to the extent to which a European patent application or Europeanpatent relates to such subject‑matter or activities as such.

53可专利性的排除

下列各项不应当授予欧洲专利:

a)发明的商业应用违反公序良俗;仅某些或所有缔约国法律或法规禁止应用的发明不应当视为违反公序良俗;

b)动植物品种或者生产动植物的实质性生物学方法;本款不应当适用于微生物方法及微生物方法生产的产品;

c)人或动物体的手术治疗方法,以及作用于人或动物体的治疗和诊断方法;本款不应当适用于该方法中所使用的产品,尤其是物质或组合物。

Article 53 Exceptions to patentability European patents shall not begranted in respect of:  

(a)inventions the commercial exploitation ofwhich would be contrary to "ordre public" or morality; suchexploitation shall not be deemed to be so contrary merely because it isprohibited by law or regulation in some or all of the Contracting States;

(b)plant or animal varieties or essentiallybiological processes for the production of plants or animals; this provisionshall not apply to microbiological processes or the products thereof;

(c)methods for treatment of the human oranimal body by surgery or therapy and diagnostic methods practised on the humanor animal body; this provision shall not apply to products, in particularsubstances or compositions, for use in any of these methods.

54新颖性

1)若发明不构成现有技术,则应当认为发明具有新颖性。

2)现有技术包括公众在欧洲专利申请的申请日之前,通过书面或口头描述、使用或者其他方式知晓的任何事情。

3)另外,递交的欧洲专利申请的内容,其申请日早于第2款所指日期,并在该日期或该日期之后公开,也应当视为现有技术。

4)只要现有技术中的任何物质或组合物在第2款和第3款所指方法中的使用不构成现有技术,则第2款和第3款不应当排除构成现有技术的该物质或组合物在第53c)条所指方法中使用的可专利性。

5)只要第4款所指任何物质或组合物在第53c)条所指方法中的特殊用途不构成现有技术,则第2款和第3款也不应当排除物质或组合物在第53c)条所指方法中的特殊用途的可专利性。

Article 54 Novelty

(1)An invention shall be considered to be new if it does not formpart of the state of the art.

(2)The state of the art shall be held tocomprise everything made available to the public by means of a written or oraldescription, by use, or in any other way, before the date of filing of theEuropean patent application.

(3)Additionally, the content of Europeanpatent applications as filed, the dates of filing of which are prior to thedate referred to in paragraph 2 andwhich were published on or after that date, shall be considered as comprised inthe state of the art.

(4)Paragraphs 2 and 3 shallnot exclude the patentability of any substance or composition, comprised in thestate of the art, for use in a method referred to in Article 53(c),provided that its use for any such method is not comprised in the state of theart.

(5)Paragraphs 2 and 3 shallalso not exclude the patentability of any substance or composition referred toin paragraph 4 forany specific use in a method referred to in Article 53(c),provided that such use is not comprised in the state of the art.

55不丧失新颖性的公开

1)第54条中的欧洲专利申请在递交之前6个月内,由于下列情形导致的发明公开不损害该申请的新颖性:

a)申请人或原持有人的明显滥用;

b)申请人或原持有人在19281122号于巴黎签订并于19721130日修订的国际展览会公约所规定的官方主办或官方承认的国际展览会上展出其发明。

2)对于第1b)款的规定,只有当申请人在递交欧洲专利申请时声明发明已经展出并且根据实施细则规定的期限和条件递交证明文件,才应当适用第1款的规定。

Article 55 Non-prejudicial disclosures

1)For the application of Article 54,a disclosure of the invention shall not be taken into consideration if itoccurred no earlier than six months preceding the filing of the European patentapplication and if it was due to, or in consequence of:

(a) an evidentabuse in relation to the applicant or his legal predecessor, or

(b)the fact that the applicant or his legalpredecessor has displayed the invention at an official, or officiallyrecognised, international exhibition falling within the terms of the Conventionon international exhibitions signed at Paris on 22 November 1928 and lastrevised on 30 November 1972.

(2)In the case of paragraph 1(b),paragraph 1 shall apply only if the applicant states, when filing theEuropean patent application, that the invention has been so displayed and filesa supporting certificate within the time limit and under the conditions laiddown in the Implementing Regulations.

56创造性

对本领域技术人员而言,若发明相对于现有技术非显而易见,则该发明应当视为具有创造性。若现有技术还包含第54条第3款所指的文件,则该文件在决定是否具有创造性时不予考虑。

Article 56 Inventive step

An invention shall be considered as involving an inventive step if,having regard to the state of the art, it is not obvious to a person skilled inthe art. If the state of the art also includes documents within the meaningof Article 54,paragraph 3, these documents shall not be considered indeciding whether there has been an inventive step.

57工业应用

若发明能在包含农业的各种产业中制造或应用,则该发明应当视为易于工业应用。

Article 57 Industrial  application

An invention shall be considered as susceptible of industrialapplication if it can be made or used in any kind of industry, includingagriculture.
