第164条实施细则和议定书

（1）实施细则，承认议定书，特权和豁免议定书，集中化议定书，关于第69条解释的议定书，以及人员补充议定书是本公约不可或缺的部分；

（2）在本公约的条款和实施细则的条款发生冲突的情况下，本公约的条款优先适用。

Article 164 Implementing Regulationsand Protocols

(1)The Implementing Regulations, theProtocol on Recognition, the Protocol on Privileges and Immunities, theProtocol on Centralisation, the Protocol on the Interpretation of Article 69 andthe Protocol on Staff Complement shall be integral parts of this Convention.

(2)In case ofconflict between the provisions of this Convention and those of the ImplementingRegulations, the provisions of this Convention shall prevail.

第165条签字–批准

（1）本公约对参加建立授予专利的欧洲体系的政府间会议的国家或者收到开会通知并受邀参加的国家开放签字到1974年4月5日。

（2）本公约应当批准，批准书应当由德意志联邦共和国保存。

(1) ThisConvention shall be open for signature until 5 April 1974 by the Stateswhich took part in the Inter‑Governmental Conference for the setting up of aEuropean System for the Grant of Patents or were informed of the holding ofthat conference and offered the option of taking part therein.

(2)This Convention shall be subject toratification; instruments of ratification shall be deposited with theGovernment of the Federal Republic of Germany.

第166条加入

（1）本公约对下列国家开放：

（a）第165条第1款所指的国家；

（b）行政委员会邀请的其他任何国家；

（2）任何曾经为本公约成员并根据第172条第4款的请求终止的任何国家，可以通过加入本公约再次成为本公约的成员；

（3）加入书应当由德意志联邦共和国保存。

(1)This Convention shall be open toaccession by:

(a)the States referred to in Article 165,paragraph 1;

(b)any other European State at theinvitation of the Administrative Council.

(2)Any State which has been a party to theConvention and has ceased to be so as a result of the application of Article 172,paragraph 4, may again become a party to the Convention byacceding to it.

(3)Instruments of accession shall bedeposited with the Government of the Federal Republic of Germany.

第168条 适用的地域

（1）任何缔约国可以在其批准书或加入书中，或在此后的任何时间向德意志联邦共和国的书面通知中声明，本公约适用于其负责的对外关系中一个或多个领土。授予该缔约国欧洲专利对声明生效的领土具有效力；

（2）如果第1款所指的声明包含在批准书或加入书中，它应与批准或加入的同一天生效；如果声明通知在保存批准书或加入书之后，该通知应在德意志联邦共和国收到之日起6个月后生效。

（3）任何缔约国可以在任何时间声明该公约应终止适用于根据第1款所作声明有关的一些或所有领土。该声明应在德意志联邦共和国收到通知之日起1年后生效。

(1)Any Contracting State may declare in itsinstrument of ratification or accession, or may inform the Government of theFederal Republic of Germany by written notification at any time thereafter,that this Convention shall be applicable to one or more of the territories forthe external relations of which it is responsible. European patents granted forthat Contracting State shall also have effect in the territories for which sucha declaration has taken effect.

(2)If the declaration referred to in paragraph 1 iscontained in the instrument of ratification or accession, it shall take effecton the same date as the ratification or accession; if the declaration isnotified after the deposit of the instrument of ratification or accession, suchnotification shall take effect six months after the date of its receipt by theGovernment of the Federal Republic of Germany.

(3)Any Contracting State may at any timedeclare that the Convention shall cease to apply to some or to all of theterritories in respect of which it has given notification pursuant to paragraph 1.Such declaration shall take effect one year after the date on which theGovernment of the Federal Republic of Germany received notification thereof.

第169条  生效

（1）本公约应于1970年在其领土内专利申请最少为180000件的6个国家最后递交批准书或加入书后的3个月生效；

（2）本公约生效后的任何批准书或加入书应当自批准书或加入书保存在德意志联邦共和国之后三个月的第一天生效。

(1)This Convention shall enter into forcethree months after the deposit of the last instrument of ratification oraccession by six States on whose territory the total number of patentapplications filed in 1970 amounted to at least 180 000 for all the saidStates.

(2)Any ratification or accession after theentry into force of this Convention shall take effect on the first day of thethird month after the deposit of the instrument of ratification oraccession.

第170条  首次会费

（1）本公约生效之后批准或加入本公约的任何国家应当向本组织支付首次会费，首次会费不应当退还。

（2）首次会费应当自批准或加入生效日前的会计年度内，根据第40条第3款和第4款规定的等级，缴纳将缔约国获得比例应用于其他缔约国特别会费总和后得到的数额的5%；

（3）如果不要求在第2款所指日期前会计年度的特别会费，该条款所指的会费等级应适用该国上年要求会费的等级。

Article 170 Initial contribution

(1)Any State which ratifies or accedes tothis Convention after its entry into force shall pay to the Organisation aninitial contribution, which shall not be refunded.

(2)The initial contribution shall be 5% ofan amount calculated by applying the percentage obtained for the State inquestion, on the date on which ratification or accession takes effect, inaccordance with the scale provided for in Article 40,paragraphs 3 and4,to the sum of the special financial contributions due from the otherContracting States in respect of the accounting periods preceding the datereferred to above.

(3)In the event that special financialcontributions were not required in respect of the accounting period immediatelypreceding the date referred to in paragraph 2,the scale of contributions referred to in that paragraph shall be the scalethat would have been applicable to the State concerned in respect of the lastyear for which financial contributions were required.

第171条  公约有效期

本公约无限期生效。

Article 171 Duration of the Convention

The present Convention shall be of unlimited duration.

第172条  修订

（1）本公约可由缔约国会议修订；

（2）会议应由行政委员会准备和召集；至少3/4的缔约国出席才构成有效的会议；接受修改文本需要出席并投票的3/4缔约国同意；弃权不视为投票。

（3）本公约的修订文本，在大会规定数量的缔约国和时间批准或加入时生效。

（4）本公约修改文本生效时未批准或加入本公约修改文本的国家，即日起终止成为本公约成员。

(1)This Convention may be revised by aConference of the Contracting States.

(2)The Conference shall be prepared andconvened by the Administrative Council. The Conference shall not be validlyconstituted unless at least three‑quarters of the Contracting States are representedat it. Adoption of the revised text shall require a majority of three‑quartersof the Contracting States represented and voting at the Conference. Abstentionsshall not be considered as votes.

(3)The revised text shall enter into forcewhen it has been ratified or acceded to by the number of Contracting Statesspecified by the Conference, and at the time specified by thatConference.

(4)Such States as have not ratified oracceded to the revised text of the Convention at the time of its entry into forceshall cease to be parties to this Convention as from that time.

第173条  缔约国之间的争议

（1）没有通过协商解决的缔约国之间关于本公约解释或适用的争议，应当根据有关国家之一的请求递交到行政委员会，行政委员会应当尽力使有关国家达成协议；

（2）如果争议递交到行政委员会日起6个月内未达成协议，有关国家之一可以将争议递交至国际法院以寻求具有约束力的裁决。

Article 173 Disputes between Contracting States

(1)Any dispute between Contracting Statesconcerning the interpretation or application of the present Convention which isnot settled by negotiation shall be submitted, at the request of one of theStates concerned, to the Administrative Council, which shall endeavour to bringabout agreement between the States concerned.

(2)If such agreement is not reached withinsix months from the date when the dispute was referred to the AdministrativeCouncil, any one of the States concerned may submit the dispute to theInternational Court of Justice for a binding decision.

第174条  退出

任何缔约国随时可以退出本公约。退出应通知德意志联邦共和国。接收通知日起一年后生效。

Any Contracting State may at any time denounce this Convention.Denunciation shall be notified to the Government of the Federal Republic ofGermany. It shall take effect one year after the date of receipt of suchnotification.

第175条  已获权利的保留

（1）国家根据第172条第4款或第174条终止成为本公约成员，根据本公约已获得的权利不受影响；

（2）当指定国终止成为本公约成员，未决的欧洲专利申请应由欧洲专利局处理，至于所涉国家，此后本公约视为适用于该国。

（3）第2款应适用于在所提到的日期，异议未决或者异议期未届满的欧洲专利；

（4）本条款不影响任何终止为本公约成员根据其作为成员的公约文本处理欧洲专利的权利。

Article 175 Preservation of acquired rights

(1)In the event of a State ceasing to beparty to this Convention in accordance with Article 172,paragraph 4, or Article 174,rights already acquired pursuant to this Convention shall not be impaired.

(2)A European patent application which ispending when a designated State ceases to be party to the Convention shall beprocessed by the European Patent Office, as far as that State is concerned, asif the Convention in force thereafter were applicable to that State.

(3)Paragraph 2 shallapply to European patents in respect of which, on the date mentioned in thatparagraph, an opposition is pending or the opposition period has not expired.

(4)Nothing in this Article shall affect theright of any State that has ceased to be a party to this Convention to treatany European patent in accordance with the text to which it was a party.

第176条原缔约国的财政权利和义务

（1）根据第172条第4款或第174条终止成为本公约成员的任何国家，只能在本组织向其他国家返还同一会计期间特别会费的时间和条件下，向该国返还其根据第140条第2款缴纳的特别会费。

（2）第1款所指国家即使在终止成为本公约成员之后应继续根据第39条，根据终止成为成员当日的汇率，按比例缴纳维持欧洲专利在该国有效的维持费。

Article 176 Financial rights and obligations of former ContractingStates  

(1)Any State which has ceased to be a partyto this Convention in accordance with Article 172,paragraph 4, or Article 174,shall have the special financial contributions which it has paid pursuant toArticle 40,paragraph 2, refunded to it by the Organisation only at thetime when and under the conditions whereby the Organisation refunds specialfinancial contributions paid by other States during the same accounting period.

(2)The State referred to in paragraph 1 shall,even after ceasing to be a party to this Convention, continue to pay theproportion pursuant to Article 39 ofrenewal fees in respect of European patents remaining in force in that State,at the rate current on the date on which it ceased to be a party.

第177条公约的语言

（1）本公约用英语、法语和德语撰写，应保存于德意志联邦共和国档案馆；三种文本效力等同；

（2）用缔约国官方语言但非第一款指定语言撰写的公约文本，如果经行政委员会认可，则可视为官方文本。不同文本之间的解释不一致时，以第一款所指的文本为准。

Article 177 Languages of the Convention

(1)This Convention, drawn up in a singleoriginal, in the English, French and German languages, shall be deposited inthe archives of the Government of the Federal Republic of Germany, the threetexts being equally authentic.

(2)The texts of this Convention drawn up inofficial languages of Contracting States other than those specified in paragraph 1 shall,if they have been approved by the Administrative Council, be considered asofficial texts. In the event of disagreement on the interpretation of thevarious texts, the texts referred to in paragraph 1 shallbe authentic.

第178条传送和通知

（1）德意志联邦共和国政府应当制作本公约的正式公证副本并将其传送到所有签字或加入国政府；

（2）德意志联邦共和国政府应当通知第1款所指政府：

（a）批准或加入书的保存；

（b）收到根据168条的声明或通知；

（c）收到根据174条的退出以及退出生效日；

（d）德意志联邦共和国政府应当将本公约在联合国秘书处登记。

全权大使已经行使其全部的权利，确认无误，签署本公约，特此证明。

(1)The Government of the Federal Republic ofGermany shall draw up certified true copies of this Convention and shalltransmit them to the Governments of all signatory or acceding States.

(2)The Government of the Federal Republic ofGermany shall notify to the Governments of the States referred to in paragraph 1:

(a)the deposit of any instrument ofratification or accession;

(b)any declaration or notificationreceived pursuant to Article 168;

(c)any denunciation received pursuantto Article 174 andthe date on which such denunciation comes into force.

(3)The Government of the Federal Republic ofGermany shall register this Convention with the Secretariat of the UnitedNations.

IN WITNESS WHEREOF, the Plenipotentiaries authorised thereto, havingpresented their Full Powers, found to be in good and due form, have signed thisConvention.
